ARTIST – PROMOTER Agreement

1 - Object
The PROMOTER wishes to engage the services of the ARTIST for a live performance at an event and the ARTIST agrees to provide such services on the terms and conditions set out in this Agreement.
2 - Event
Venue: Le Trianon
Date: 15/01/2015
Performance time: 21:00
Performance duration: 30 minutes
Load In time: 18:00
Soundcheck time: 19:00
Soundcheck duration: 5 to 10 minutes
Dinner: 20:00
3 – Artist Obligations

The ARTIST agrees to be at the place of soundcheck and at the place of live performance at the scheduled time.

Where a manager or an agent is entering into this Agreement on behalf of the ARTIST, that manager or agent warrants that they have the authority to bind the ARTIST.

The ARTIST agrees to make herself available upon reasonable notice from the PROMOTER for a limited number of promotional activities and/or personal appearances and/or interviews for the purpose of promotion of the Event.

The ARTIST agrees to independently promote the event on his social-media pages and website.

The ARTIST agrees to maintain good communication and share important information relating to the event with the PROMOTER within reasonable notice.

The ARTIST agrees to provide the PROMOTER with her Rider and Technical requirements within at least thirty days of the date of the event.
4 – Promoter Obligations

The PROMOTER agrees to provide a venue and sales facilities on the night of the show.

The PROMOTER agrees to promote the show to the best of his capabilities and resources.

The PROMOTER agrees to send the artist the technical specifications of the venue within thirty days previous to the event.

The PROMOTER agrees to pay for and supply a well functioning and high standard quality P.A. system and the backline equipment stated in the ARTIST’s Technical requirements.

The PROMOTER agrees to provide proper security to ensure the sufficient supervision of the venue and to prevent the entry of undesirables and ensure proper conduct of the audience, the safety of the Artist, the preservation of order, provide appropriate stage security and to be in compliance with all regulations in the “2003 Licensing Act” and the “2004 Private Security Industry Regulations”.

The PROMOTER agrees to organise and supply the Artist with free transportation to and from the Venue, including all transfers and baggage costs.

The PROMOTER shall provide and pay for accommodation for the ARTIST and his MANAGER. The PROMOTER must ensure the accommodation meets, at least, the following conditions:
-Three Star accommodation;
-Checkout time for the Artist shall be no earlier than 1.00pm on the day of departure.

The PROMOTER agrees to provide one main meal with drink, alcoholic if desired, to the ARTIST and a maximum of 3 other individuals.

The PROMOTER agrees to pay for and supply the ARTIST with all of the elements contained in her personal Rider, on the day of the event prior to the performance.
5 – Fee and Payment

In consideration for the ARTIST’s services under this Agreement the PROMOTER agrees to pay to the Artist a performance guaranteed fee of €150 as follows:

A Non-refundable deposit of €50 to be paid to the ARTIST, immediately upon signing of this Agreement; and

The balance of the guaranteed Fee being €100 to be paid to the ARTIST immediately prior to the commencement of the Performance. The ARTIST shall have the right to cancel this Agreement if either the Deposit or the Balance is not paid in the times specified.
6 – Accounting

Any accounts relating to ARTIST’s payments shall be transparent and accessible to ARTIST and artist manager upon request with reasonable prior notice.
8 - Merchandising

ARTIST shall have the right to sell merchandising at the performance and shall retain the total profit of merchandising sales. The PROMOTER agrees to organise a space in the venue for the ARTIST's merchandise.
9 - Restrictions

The PROMOTER shall not be entitled to record, video tape, reproduce, transmit or share any part of the ARTIST’s Performance, nor shall he encourage any such behaviour, but on the contrary refrain it.
10 – Cancellation

In the event that the ARTIST shall cancel her performance, the advanced deposit shall be returned in full to the PROMOTER.

In the event that the PROMOTER shall cancel the show for any reason (not withstanding any acts of God) without at least a four weeks notice, the PROMOTER shall forfeit the advanced deposit and shall pay the ARTIST half of the agreed guaranteed fee.

In the event that the PROMOTER shall cancel the show for any reason (not withstanding any acts of God) within two weeks of the agreed performance date, the PROMOTER shall pay the ARTIST the agreed guaranteed fee in full.
11 - Termination

The ARTIST and PROMOTER shall be entitled to terminate this agreement at any time upon the any breach of any of the above stated responsibilities and/or clauses by any of the parties.
12 – Miscellaneous

The law of the country in which it was signed shall govern this contract.
